Terms & Conditions for Chocolate Box Training
1. Introduction
Welcome to Chocolate Box Training. Chocolate Box Training is owned and operated under Sleaping Giant Pty Ltd (ABN: 96 607 326 036, trading as Chocolate Box Training, Motus Health & Performance, Chocolate Box Films). These Terms & Conditions govern your use of our facilities, services, website, and related technologies. By signing up for membership, using our services, or accessing our facilities, you agree to these terms.
2. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and storage of your personal and sensitive information comply with the Privacy Act 1988 (Cth) and other applicable laws.
- Biometric Data: For members utilizing 24/7 access, we use facial recognition technology to verify identity and ensure secure access. This data is collected only with your explicit consent and stored securely.
- Privacy Policy: For details on how we manage your personal data, please review our Privacy Policy.
- Your Rights: You have the right to access, correct, or request the deletion of your personal data, including biometric data, at any time. Contact us at hello@chocolateboxtraining.com.
3. Age Requirements for Membership & Participation
3.1. Minimum Age for Membership
3.1.1. Membership at a Sleaping Giant Pty Ltd operated location is open to individuals aged 8 years and above.
3. 1.2. Youth memberships (for those under 18 years) require a parent or legal guardian to complete and sign the membership agreement on behalf of the minor.
3.1.3. Sleaping Giant Pty Ltd offers structured programs tailored to younger members, including:
- MiniBox (8-12 years) – Fully supervised, coach-led training sessions.
- Youth Program (13-15 years) – Fully supervised, coach-led training sessions.
- Athlete Program (12 years and up) - Fully supervised, coach-led sessions.
- 24/7 and / or Open Gym access is not available to members aged 16 years and under.
3.2. Youth Memberships (Under 18s) & Parental Consent
3.2.1. Members under 18 must have written consent from a parent or legal guardian before joining.
3.2.2. A parent or guardian must be present during the initial sign-up process.
3.2.3. Parents/guardians acknowledge that by providing consent, they accept responsibility for the minor’s adherence to gym rules and payment obligations.
3.3. Supervision & Safety for Underage Members
3.3.1. All MiniBox (8-12 years) and Youth Program (13-15 years) classes are fully supervised and coach-led, meaning parents/guardians are not required to attend sessions.
3.3.2. Members aged under 16 who are participating in the Athlete Program must do so within fully supervised and coach-led sessions only and must not train during unsupervised sessions
3.3.2. Members aged 16 years and under do not have access to Open Gym or 24/7 Gym Access and may only participate in structured, supervised classes.
3.3.3. Sleaping Giant Pty Ltd reserves the right to restrict access to specific activities, equipment, or training sessions based on safety considerations and developmental appropriateness.
3.4. Liability & Waiver for Underage Members
3.4.1. By enrolling a minor, parents/guardians acknowledge the inherent risks associated with physical activity and agree to indemnify Sleaping Giant Pty Ltd from claims resulting from participation.
3.4.2. All members under 18 must have a signed waiver from their parent/guardian before participating in any gym activities.
3.4.3. Sleaping Giant Pty Ltd reserves the right to suspend or cancel memberships for underage members if safety rules or behavioural expectations are not met.
3.5. Membership Upgrades & Transition to Adult Membership
3.5.1. Youth memberships automatically transition to adult memberships at age 18, subject to new terms, pricing, and conditions.
3.5.2. A new agreement must be signed upon reaching adulthood, with updated payment details if required.
4. Membership Terms
4.1 Membership Options
We offer a range of membership plans to suit your needs. Details, pricing, and inclusions are available on our Membership Prices page or our website www.chocolateboxtraining.com.
If you wish to make a change to your membership package, you must provide a minimum of 10 days notice. These requests should be made via email to hello@chocolateboxtraining.com.
If you are an Unlimited member with access to HOT Recovery, the following terms apply:
- “Unlimited Plus” $89 and Athlete $129 members have access to 1x HOT Recovery session per week. You have a choice of a double suite or a single suite. If you are using the sauna solo, then you must book a single suite. If you are sweating it out with a mate, then please book a double suite.
- “Unlimited Plus” $109 members have access to 2x HOT Recovery sessions per week. Please follow the booking etiquette outlined above.
4.2 Minimum Term Agreement
To ensure you get the most out of your membership, the lock in period for all new members is 26 financial weeks. Note, the Athlete Program is a 5 week lock in due to the nature of the programming and athlete commitments. There is no minimum term agreement required for Motus Group Rehab memberships, due to the nature of the activity.
4.3 Casual Visits:
- Drop In Session - only available to visitors + non-local residents above 18 years. Can be purchased via the Chocolate Box Training App or online timetable. Must be used within 7 days from the date of purchase. If you fail to show up to your booked class, you will forfeit your pass.

Drop In Week - only available to first-time visitors + non-local residents above 18 years. Can be purchased via the Chocolate Box Training App or online timetable. Must be used within 7 days from the date of purchase. Not transferable. Expiry date cannot be extended.
4.4 Cancellation and Suspension
- Cancellation: You can cancel your membership within the Minimum Term Agreement, but the remainder of the minimum weekly charges will not be reimbursed. You can choose to pay out your remaining weeks or transfer them to a friend or family member. Cancellation of memberships outside the Minimum Term Agreement can be made. Allow 10 days’ notice via email to hello@chocolateboxtraining.com for any cancellations to your account.
- Suspension: Members may cancel their membership by providing 10 days notice via email to hello@chocolateboxtraining.com. Memberships can be suspended for a maximum of 4 weeks for holidays (if travelling for longer, please supply documentation); injury hold for a maximum of 8 weeks, and pregnancy hold for a maximum of 12 weeks. Where possible, Those on weekly membership payments must give 10 days notice. Fortnightly payments must give 3 weeks notice and monthly payments must give 6 weeks notice. All requests must be sent via email to hello@chocolateboxtraining.com.
4.5 Fees & Charges:
- Insufficient Funds – Your bank or credit provider may charge you an overdraw fee for insufficient funds. You may also incur an administration fee of $5.00 AUD.
- Infractions - Any dishonours caused by the member will incur a $5.00 AUD fee.
- Late Fees: A $3 AUD late cancellation or no show fee will be applied for STRONG and SWEAT. A late fee of $15 AUD will be charged for a no-show or if not checked into (in the building) 5 minutes prior to the start of any Reformer Pilates Class or Yoga Class. You must cancel out of class or remove yourself from the waitlist 2hrs before start class time. Please note, an additional administration charge may be charged based on payment method by our third-party biller (MINDBODY/Stripe).
- A transaction fee of $0.69 applies to all membership debits. Note there is an additional transaction fee of 1.39% +$0.25 for all payments processed using credit card (including AMEX). These fees are automatically applied to your account upon each transaction and are not covered by Chocolate Box Training.
4.6 Pricing Adjustments

Membership Fee Reviews: a) We reserve the right to review and adjust membership fees periodically to reflect changes in operational costs, industry standards, and service enhancements. Any fee adjustments will be made in accordance with applicable consumer protection laws.

Notice of Changes: a) If we make any changes to your membership fees, we will provide you with at least 14 days’ written notice via email or other suitable communication methods.
b) The updated fees will apply from the effective date specified in the notice.
- Member Rights in Response to Fee Changes: a) If you do not agree with a fee adjustment, you may terminate your membership without penalty by providing written notice (10 day notice period will still apply). b) If no termination notice is received, the adjusted fees will apply from the effective date, and your ongoing membership will continue as normal.
- Direct Debit Adjustments: a) If your membership fees are paid via direct debit, you authorize us (or our billing provider) to adjust the debit amount accordingly after the notice period.Client membership rates will increase on their next scheduled billing date on or after the date of the effective price increase.
4.7 Changes to Method of Payment
Changes to method of payment must be made directly at Reception, via phone at 9971 5194 or via email to hello@chocolateboxtraining.com. Please note that changing payment details on the CBT App does not update on our system.
4.8 Refunds
Refunds for unused services or prepaid memberships are subject to approval and applicable fees. No refunds are provided for missed classes or late cancellations unless under exceptional circumstances.
5. Facility Use
5.1 Code of Conduct
Members must:
- Treat staff and fellow members with respect.
- Use equipment safely and appropriately.
- Adhere to hygiene practices, such as cleaning machines after use, wearing suitable gym attire.
- Towel usage is compulsory.
- Return all equipment after use, do not drop weights unnecessarily.
5.2 Access Control
- Members using 24/7 access must not share access credentials or allow unauthorized individuals to enter.
- Facial recognition is used to enhance security and prevent unauthorized entry. Alternative access methods are available upon request.
5.3 Children and Minors
- Children under 6 months or unable to sit independently are not permitted in the gym except in designated pram-friendly classes under the supervision of their parent and/or guardian.
- Free child-minding services are provided during specific hours for children aged 6 months (or those that can sit independently), up to 12 years of age.
5.4 Class Booking Policy
- Members must book into all classes in advance, and only attend classes to which they are booked into.
- A $3 AUD late cancellation or no show fee will be applied for STRONG and SWEAT. A late fee of $15 AUD will be charged for a no-show or if not checked into (in the building) 5 minutes prior to the start of any Reformer Pilates Class. You must cancel out of class or remove yourself from waitlist 2hrs before start class time. 5.5 Etiquette for Body Composition Scans:
Unlimited Plus and Athlete members have unlimited access to InBody Composition Scans. You must check in with reception prior to your scan. It is important to note that clients who have a scheduled appointment will get priority.
6. Special Services
6.1 24/7 Access Risks
Members acknowledge that during unstaffed hours, there may be increased risks. You are responsible for your safety and must act cautiously.
Agree to safety induction of 24/7 gym usage including use of duress lanyard in case of an emergency. If this usage policy is not adhered to, you will be liable for any associated costs.
6.2 Classes and Booking Policies
- Reformer Pilates, SWEAT, STRONG, and all other classes require advance booking.

Late cancellations or no-shows may result in a fee as outlined in our Fee & Charges and Class Booking Policy.
6.3 Gift Certificates
- Gift certificates can be purchased from Chocolate Box Training and can be used towards HOT Recovery, Chocolate Box Training membership or retail purchases in-store or online. The following terms and conditions apply:
- Vouchers can be purchased at Reception or from our online store.
- Valid for 6 months from the date of purchase.
- Voucher must be present at time of redemption.
- Non - transferable.
7. Media Consent
By participating in classes, events, or using our facilities, members grant Chocolate Box Training the right to capture photos and videos for promotional purposes, including but not limited to social media, advertising, and website use.
Agreement to Use: Members agree that Chocolate Box Training may use their image without financial compensation.
Opt-Out Process: Members can opt out of media use by providing written notice to hello@chocolateboxtraining.com. Upon receiving the opt-out request, Chocolate Box Training will ensure reasonable steps are taken to respect the member's preference.
8. Liability and Disclaimers
8.1 Fitness and Health Disclaimer
Members are advised to consult with a medical professional before beginning any exercise program. Chocolate Box Training is not liable for injuries, illnesses, or adverse health outcomes resulting from gym use.
8.2 Liability Limitation
To the extent permitted by law, our liability is limited to the resupply of services or refund of membership fees.
9. Technology and Intellectual Property
9.1 Website and App Use
Members must not misuse our website, app, or any digital platforms. Unauthorized access or tampering with technology systems is prohibited.
9.2 Intellectual Property
All content, branding, and training methods are the property of Chocolate Box Training and must not be reproduced without permission.
10. Changes to Terms
Chocolate Box Training reserves the right to update these Terms & Conditions. Significant changes will be communicated via email or a website announcement.
11. Dispute Resolution
In the event of a dispute, we encourage members to contact us directly to resolve the matter amicably. If unresolved, disputes will be governed by the laws of New South Wales, Australia, and referred to mediation before legal proceedings.

HYBRID HYROX PROMOTION TERMS & CONDITIONS
- This offer to receive a race entry to Sydney HYROX as part of a CBT HYBRID membership is valid from 8 April to 30 April 2025.
- This offer is on a first come, first serve basis, and there is no guarantee that you will receive your preferred race day if ticket allocations have been exhausted.
- Offer is applicable to new members during the above promotional period.
- Existing members are not applicable for this offer.
- Offer is not valid within conjunction with any other offer.
- Race tickets remain the property of Chocolate Box Training. If you are unable to compete, you may not transfer your ticket to another person.
- The above Promotional Terms and Conditions are specific to this promotion, they do not constitute the full Terms and Conditions of the Chocolate Box Training membership programme. Before joining Chocolate Box Training, you are required to read and agree to the Chocolate Box Training Terms and Conditions in full.
- In the event of any conflict between these Promotional Terms and Conditions and the Chocolate Box Training membership full Terms and Conditions, the latter will prevail.
